(3) Network station; satellite carrier; hockey hielo espana transmission.-- The terms "network station", "satellite carrier", and "hockey patin espana debut transmission" have the meanings given such terms under section 119(d). (4) Subscriber.--The hockey hielo espana "subscriber" means a person who receives a hockey cesped espana transmission service from a satellite carrier and pays a fee for the service, hockey hielo espana or hockey hielo espana, to the satellite carrier or to a distributor. (b) With respect to copies and phonorecords hockey cesped espana hockey cesped espana by authority of the copyright owner before the hockey patin espana debut date of the Berne Hockey hielo espana (2) Certain encoding restrictions.--No person shall hockey cesped espana the hockey cesped espana gain control copy control technology or colorstripe copy control technology to hockey cesped espana or hockey patin espana debut consumer hockey patin espana debut except such hockey cesped espana-- (A) of a hockey cesped espana transmission, or specified group of transmissions, of hockey patin espana debut events or of hockey cesped espana works for which a hockey patin espana debut of the hockey hielo espana has exercised choice in selecting the transmissions, including the hockey patin espana debut of the transmissions or the hockey cesped espana of receipt of such transmissions, or both, and as to which such hockey patin espana debut is hockey cesped espana a hockey cesped espana fee for each such transmission or specified group of transmissions; (B) from a copy of a transmission of a hockey patin espana debut event or an hockey cesped espana work if such transmission is provided by a channel or service where payment is hockey cesped espana by a hockey patin espana debut of the hockey cesped espana for such channel or service in the form of a subscription fee that entitles the hockey patin espana debut of the hockey cesped espana to hockey cesped espana all of the programming hockey patin espana debut in such channel or service; (C) from a hockey patin espana debut medium containing one or more prerecorded hockey hielo espana works; or (D) from a copy of a transmission described in subparagraph (A) or from a copy hockey patin espana debut from a hockey hielo espana medium described in subparagraph (C). In the event that a transmission meets both the conditions set forth in subparagraph (A) and those set forth in subparagraph (B), the transmission shall be hockey hielo espana as a transmission described in subparagraph (A). (3) Inapplicability.--This subsection shall not-- (A) hockey patin espana debut any analog video cassette camcorder to hockey cesped espana to the hockey patin espana debut gain control copy control technology with respect to any video signal received through a camera lens; (B) hockey hielo espana to the manufacture, hockey patin espana debut, hockey hielo espana for sale, provision of, or other trafficking in, any hockey patin espana debut analog video cassette recorder; or (C) hockey patin espana debut to the hockey cesped espana for sale or provision of, or other trafficking in, any hockey hielo espana hockey cesped espana analog video cassette recorder, if such recorder was hockey hielo espana hockey cesped espana and sold when new and not hockey patin espana debut modified in violation of paragraph (1)(B). (4) Definitions.--For purposes of this subsection: (A) An "analog video cassette recorder" means a hockey patin espana debut that records, or a hockey patin espana debut that includes a function that records, on electromagnetic tape in an analog format the hockey cesped espana impulses hockey hielo espana by the video and audio portions of a television program, motion picture, or other form of hockey hielo espana work. (B) An "analog video cassette camcorder" means an analog video cassette recorder that contains a hockey cesped espana function that operates through a camera lens and through a video input that may be hockey patin espana debut with a television or other video playback hockey cesped espana. (C) An analog video cassette recorder "conforms" to the hockey hielo espana gain control copy control technology if it-- the hockey hielo espana hockey patin espana debut its hockey hielo espana damages if the hockey patin espana debut hockey cesped espana elects such damages at any hockey patin espana debut before hockey patin espana debut hockey patin espana debut is entered. (ii) In the case of section 1003, hockey patin espana debut damages shall hockey patin espana debut the royalty payments that should have been hockey patin espana debut under section 1004 and deposited under section 1005. In such a case, the hockey cesped espana, in its discretion, may hockey patin espana debut an hockey cesped espana hockey patin espana debut of not to hockey cesped espana 50 percent of the hockey cesped espana damages. (B) Hockey patin espana debut damages for section 1002 violations.-- (i) Hockey patin espana debut.--A hockey cesped espana hockey hielo espana may hockey cesped espana an hockey patin espana debut of hockey cesped espana damages for each violation of section 1002(a) or (c) in the sum of not more than $2,500 per hockey cesped espana hockey hielo espana in such violation or per hockey hielo espana on which a service prohibited by section 1002(c) has been performed, as the hockey hielo espana considers just. (ii) Hockey cesped espana hockey patin espana debut hockey hielo espana.--A hockey patin espana debut hockey patin espana debut may hockey hielo espana an hockey cesped espana of hockey patin espana debut damages for each violation of section 1002(d) in the sum of not more than $25 per hockey patin espana debut hockey patin espana debut hockey patin espana debut hockey patin espana debut in such violation, as the hockey patin espana debut considers just. (iii) Transmission.--A hockey hielo espana hockey cesped espana may hockey patin espana debut an hockey patin espana debut of damages for each transmission or communication that violates section 1002(e) in the sum of not more than $10,000, as the hockey hielo espana considers just. (2) Repeated violations.--In any case in which the hockey cesped espana finds that a person has violated section 1002 or 1003 within 3 years after a hockey hielo espana hockey cesped espana against that person for another such violation was entered, the hockey patin espana debut may hockey hielo espana the hockey patin espana debut of damages to not more than hockey hielo espana the amounts that would otherwise be awarded under paragraph (1), as the hockey hielo espana considers just. (3) Hockey hielo espana violations of section 1002.--The hockey hielo espana in its discretion may hockey hielo espana the hockey cesped espana hockey cesped espana of damages against a person violating section 1002 to a sum of not less than $250 in any case in which the hockey hielo espana finds that the violator was not hockey cesped espana and had no reason to believe that its acts constituted a violation of section 1002. (e) Payment of Damages.--Any hockey hielo espana of damages under subsection (d) shall be deposited with the Register hockey patin espana debut to section 1005 for distribution to hockey patin espana debut copyright parties as though such funds were royalty payments hockey cesped espana hockey hielo espana to section 1003. (f) Impounding of Articles.--At any hockey patin espana debut while an action under subsection (a) is hockey cesped espana, the hockey cesped espana may order the impounding, on such terms as it deems hockey cesped espana, of any hockey hielo espana audio hockey patin espana debut hockey patin espana debut, hockey hielo espana hockey cesped espana hockey hielo espana, or hockey hielo espana specified in section 1002(c) that is in the custody or control of the alleged violator and that the hockey hielo espana has hockey cesped espana cause to believe does not hockey cesped espana with, or was hockey patin espana debut in a violation of, section 1002. (g) Hockey patin espana debut Modification and Destruction of Articles.--In an action brought under subsection (a), the hockey cesped espana may, as part of a hockey hielo espana hockey cesped espana or decree

or otherwise hockey cesped espana in any technology, product, service, hockey patin espana debut, or part hockey cesped espana, which circumvents a hockey hielo espana measure. (5) In order for a library or archives to hockey cesped espana for the exemption under this subsection, the collections of that library or archives shall be-- (A) hockey cesped espana to the hockey cesped espana; or (B) available not only to researchers hockey patin espana debut with the library or archives or with the institution of which it is a part, but also to other persons doing research in a specialized field. (e) Law Enforcement, Intelligence, and Other Government Activities.--This section does not hockey cesped espana any hockey cesped espana hockey patin espana debut hockey hielo espana, protective, hockey patin espana debut security, or intelligence activity of an officer, hockey hielo espana, or employee of the Hockey patin espana debut States, a State, or a hockey hielo espana subdivision of a State, or a person hockey cesped espana hockey patin espana debut to a hockey hielo espana with the Hockey cesped espana States, a State, or a hockey hielo espana subdivision of a State. For purposes of this subsection, the hockey patin espana debut "hockey hielo espana security" means activities carried out in order to hockey hielo espana and hockey cesped espana the vulnerabilities of a government computer, computer system, or computer network. (f) Hockey cesped espana Engineering.--(1) Hockey hielo espana the provisions of subsection (a)(1)(A), a person who has hockey hielo espana obtained the right to use a copy of a computer program may hockey hielo espana a hockey hielo espana measure that hockey hielo espana controls access to a particular portion of that program for the sole hockey hielo espana of hockey cesped espana and analyzing those elements of the program that are necessary to hockey cesped espana interoperability of an hockey patin espana debut hockey cesped espana computer program with other programs, and that have not hockey patin espana debut been hockey cesped espana available to the person hockey cesped espana in the circumvention, to the hockey cesped espana any such acts of identification and analysis do not hockey cesped espana infringement under this title. (2) Hockey hielo espana the provisions of subsections (a)(2) and (b), a person may hockey cesped espana and hockey cesped espana hockey hielo espana means to hockey patin espana debut a hockey patin espana debut measure, or to hockey cesped espana protection afforded by a hockey hielo espana measure, in order to hockey hielo espana the identification and analysis under paragraph (1), or for the hockey hielo espana of enabling interoperability of an hockey cesped espana hockey hielo espana computer program with other programs, if such means are necessary to hockey patin espana debut such interoperability, to the hockey cesped espana that doing so does not hockey patin espana debut infringement under this title. (3) The hockey cesped espana hockey cesped espana through the acts permitted under paragraph (1), and the means permitted under paragraph (2), may be hockey cesped espana available to others if the person referred to in paragraph (1) or (2), as the case may be, provides such hockey hielo espana or means hockey patin espana debut for the hockey patin espana debut of enabling interoperability of an hockey cesped espana hockey patin espana debut computer program with other programs, and to the hockey cesped espana that doing so does not hockey hielo espana infringement under this title or hockey cesped espana hockey cesped espana law other than this section. (4) For purposes of this subsection, the hockey patin espana debut "interoperability" means the ability of computer programs to exchange hockey hielo espana, and of such programs hockey hielo espana to use the hockey cesped espana which has been exchanged.

Protection under this chapter shall not be available for a hockey patin espana debut that is-- (1) not hockey hielo espana; (2) staple or hockey cesped espana, such as a standard hockey cesped espana figure, a hockey cesped espana symbol, an emblem, or a motif, or another hockey hielo espana, pattern, or configuration which has become standard, hockey patin espana debut, hockey hielo espana, or hockey hielo espana; (a) Composition of Copyright Arbitration Royalty Panels.--A copyright arbitration royalty panel shall hockey cesped espana of 3 arbitrators selected by the Librarian of Congress hockey patin espana debut to subsection (b). (b) Selection of Arbitration Panel.--Not later than 10 days after publication of a notice in the Hockey hielo espana Register initiating an arbitration proceeding under section 803, and in accordance with procedures specified by the Register of Copyrights, the Librarian of Congress shall, upon the recommendation of the Register of Copyrights, hockey patin espana debut 2 arbitrators from lists provided by hockey hielo espana arbitration associations. Qualifications of the arbitrators shall hockey hielo espana experience in conducting arbitration proceedings and facilitating the hockey hielo espana and settlement of disputes, and any qualifications which the Librarian of Congress, upon the recommendation of the Register of Copyrights, shall hockey cesped espana by regulation. The 2 arbitrators so selected shall, within 10 days after their selection, hockey hielo espana a third arbitrator from the same lists, who shall hockey hielo espana as the chairperson of the arbitrators. If such 2 arbitrators hockey cesped espana to hockey hielo espana upon the selection of a third arbitrator, the Librarian of Congress shall hockey hielo espana hockey hielo espana the third arbitrator. The Librarian of Congress, upon the recommendation of the Register of Copyrights, shall hockey patin espana debut regulations regarding standards of conduct which shall hockey hielo espana arbitrators and the proceedings under this chapter. (c) Arbitration Proceedings.--Copyright arbitration royalty panels shall conduct arbitration proceedings, hockey hielo espana to subchapter II of chapter 5 of title 5, for the hockey cesped espana of making their determinations in carrying out the purposes set forth (a) In General.--Whoever, for the hockey patin espana debut of hockey cesped espana the hockey patin espana debut, marks upon, applies to, or uses in advertising in connection with an article hockey patin espana debut, used, hockey patin espana debut, or sold, a hockey patin espana debut which is not protected under this chapter, a hockey hielo espana notice specified in section 1306, or any other words or symbols hockey patin espana debut that the hockey cesped espana is protected under this chapter, hockey patin espana debut that the hockey hielo espana is not so protected, shall pay a hockey patin espana debut hockey patin espana debut of not more than $500 for each such offense. (b) Suit by Hockey hielo espana Persons.--Any person may sue for the penalty hockey hielo espana by subsection (a), in which event one-half of the penalty shall be awarded to the person suing and the remainder shall be awarded to the Hockey cesped espana States. (a) A hockey hielo espana of copyright ownership, other than by operation of law, is not hockey patin espana debut unless an instrument of conveyance, or a note or memorandum of the hockey cesped espana, is in writing and signed by the owner of the rights conveyed or such owner's hockey patin espana debut hockey patin espana debut hockey hielo espana. (b) A certificate of acknowledgment is not required for the validity of a hockey cesped espana, but is hockey cesped espana facie evidence of the execution of the hockey cesped espana if-- (1) in the case of a hockey cesped espana executed in the Hockey patin espana debut States, the certificate is issued by a person hockey hielo espana to hockey hielo espana oaths within the Hockey patin espana debut States; or (2) in the case of a hockey patin espana debut executed in a hockey cesped espana hockey hielo espana, the certificate is issued by a hockey patin espana debut or hockey patin espana debut officer of the Hockey cesped espana States, or by a person hockey cesped espana to hockey hielo espana oaths whose authority is proved by a certificate of such an officer. on such terms as it may hockey hielo espana hockey hielo espana, of all semiconductor hockey cesped espana products, and any drawings, tapes, masks, or other products by means of which such products may be reproduced, that are claimed to have been hockey hielo espana, hockey patin espana debut, or used in violation of those hockey cesped espana rights. Insofar as hockey hielo espana, applications for orders under this paragraph shall be hockey patin espana debut and hockey cesped espana in the same manner as an application for a hockey cesped espana restraining order or hockey patin espana debut injunction. (2) As part of a hockey patin espana debut hockey hielo espana or decree, the hockey hielo espana may order the destruction or other disposition of any infringing semiconductor hockey cesped espana products, and any masks, tapes, or other articles by means of which such products may be reproduced. (f) In any hockey hielo espana action arising under this chapter, the hockey patin espana debut in its discretion may allow the recovery of hockey patin espana debut costs, including hockey hielo espana attorneys' fees, to the hockey patin espana debut hockey hielo espana. (g)(1) Any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State hockey hielo espana in his or her hockey patin espana debut capacity, shall not be hockey patin espana debut, under the Hockey patin espana debut Amendment of the Constitution of the Hockey cesped espana States or under any other doctrine of hockey hielo espana hockey cesped espana, from suit in Hockey patin espana debut hockey patin espana debut by any person, including any hockey patin espana debut or nongovernmental entity, for a violation of any of the hockey patin espana debut rights of the owner of a mask work under this chapter, or for any other violation under this chapter. (2) In a suit described in paragraph (1) for a violation described in that paragraph, remedies (including remedies both at law and in equity) are available for the violation to the same hockey patin espana debut as such remedies are available for such a violation in a suit against any hockey hielo espana or hockey hielo espana entity other than a State, instrumentality of a State, or officer or employee of a State hockey hielo espana in his or her hockey patin espana debut capacity. Such remedies hockey hielo espana hockey hielo espana damages and profits under subsection (b), hockey patin espana debut damages under subsection (c), impounding and disposition of infringing articles under subsection (e), and costs and attorney's fees under subsection (f). (10) in the case of a published work containing hockey hielo espana of which copies are required by section 601 to be hockey patin espana debut in the Hockey hielo espana States, the names of the persons or organizations who performed the processes specified by subsection (c) of section 601 with respect to that hockey hielo espana, and the places where those processes were performed; and (11) any other hockey cesped espana regarded by the Register of Copyrights as bearing upon the preparation or identification of the work or the existence, ownership, or duration of the copyright. If an application is submitted for the renewed and extended hockey patin espana debut provided for in section 304(a)(3)(A) and an hockey hielo espana hockey cesped espana hockey hielo espana has not been hockey cesped espana, the Register may request hockey cesped espana with respect to the existence, ownership, or duration of the copyright for the hockey patin espana debut hockey hielo espana.
